9. EVENTS OUTSIDE OUR CONTROL

We shall have no liability to you for any breach of these Terms caused by an Event Outside Our Control. An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action, civil commotion, riot, terrorist attack (or threat), war (or threat) or fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

10.1 ‘Writing includes emails. When we use the words ‘writing’ or ‘written’ in these Terms, this includes emails.

10.2 Nobody else has any rights under these Terms. These Terms are between you and us. No other person shall have any rights to enforce any of the Terms.

10.3 If a court finds part of these Terms illegal, the rest will continue in force. Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

10.4 Even if we delay in enforcing these Terms, we can still enforce them later. If we do not insist immediately that you do anything you are required to do under these Terms, or if we delay in taking steps against you in respect of you breaching these Terms, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.

10.5 Which laws apply to these Terms and where you may bring legal proceedings. These Terms are governed by English law. This means your use of our site and any dispute or claim arising out of or in connection with your use of our site will be governed by English law. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction over such disputes and claims. However, as a consumer, you have the right to start legal proceedings in the country you are resident in if you wish.
